Overview

This Universal Terms of Service Agreement (the “Agreement”) is a legal contract between ETAS INTERNATIONAL TOURISM LLC (“we,” “our,” or “us”) and you (“you,” “your,” or “user”). This Agreement is effective as of the date you access or use this website (the “Site”) or the date you electronically accept it, whichever occurs first.

This Agreement sets forth the general terms and conditions governing your use of the Site, as well as any products, consultancy, or services made available through it (individually and collectively, the “Services”). It applies to all users of the Site, whether you are simply browsing or have purchased Services.

By accessing or using the Site, or by electronically accepting this Agreement, you:

• Acknowledge that you have read and understood this Agreement.
• Agree to be legally bound by its terms and conditions.
• Agree to comply with all additional policies, guidelines, and specific product/service agreements referenced herein.

If you do not agree to be bound by this Agreement, you should not access or use the Site or the Services.

Eligibility

This Site and the Services are available only to Users who are legally capable of entering into binding contracts under applicable law. By accessing or using this Site or the Services, you represent and warrant that you:

• Are at least eighteen (18) years of age;
• Are legally capable of entering into binding contracts under applicable law; and
• Are not prohibited from purchasing or receiving the Services under applicable laws.

Accounts

To access certain features of this Site or to use certain Services, you may be required to create an Account. You are solely responsible for all activity carried out under your Account. You must keep your Account credentials secure and notify us immediately in case of any unauthorized use.

Availability of Website/Services

We use commercially reasonable efforts to make this Site and the Services available 24/7. However, the Site or Services may be inaccessible from time to time due to maintenance, technical issues, or events beyond our reasonable control. We do not guarantee uninterrupted access.

Limitation of Liability

To the fullest extent permitted by law, ETAS INTERNATIONAL TOURISM LLC, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of this Site or Services.

We are not responsible for any consequences beyond our control, including but not limited to actions or decisions by government authorities, processing delays, or rejections of ETA applications.

Your eTA Application Fee is Non-Refundable

Once you submit your eTA application, the fee is non-refundable. This applies even if your application is denied or if there are changes to your travel plans.

Accuracy of Content

We strive to keep the information on this website accurate and up to date. However, we make no warranties regarding the completeness or accuracy of the content.

Minors

Parents, legal guardians, or accompanying adults are responsible for information submitted when applying for a Kenya eTA on behalf of minors.

Indemnity

You agree to indemnify and hold harmless ETAS INTERNATIONAL TOURISM LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of this Site or violation of these Terms.

Changes to Terms

We reserve the right to update or modify these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ajman/Dubai, UAE.
